After a 1-2 start to the 2009 NFL season, Pittsburgh Steelers quarterback Ben Roethlisberger is in need of some good news. Unfortunately, a Nevada judge was unwilling to grant him a victory in court. Judge Brent Adams denied a motion to dismiss a civil lawsuit filed by a Lake Tahoe casino worker Andrea McNulty who claims Roethlisberger raped her in 2008. The judge ruled that there is sufficient enough claim that, if proven, she would be entitled to relief.
Just as Jordan Kobritz explained in his article Football: A Game of Life and Death, in civil court, there is no “beyond reasonable doubt,” the defense only has to prove “more than likely.”
Here is a timeline of the Roethlisberger lawsuit:
March 2003: Andrea McNulty begins work as a desk clerk at Harrah’s Lake Tahoe Casino
July 2008: Ben arrives at Harrah for golf tournament
Sept. '08: McNulty treated for anxiety and depression at West Hills Hospital
Oct '08: McNulty admitted at Saint Helena Hospital
Nov. '08: McNulty admitted to Carson City Hospital for depression
Dec. '08: McNulty admitted into Barton Memorial hospital for depression and eating problems
March '09: McNulty tells doctor of alleged rape
July 17, '09: McNulty files claim against Roethlisberger
July 24, '09: Roethlisberger calls allegations “false and viscous”
Aug. 8, '09: Unnamed Harrah worker claims in sworn statement McNulty was not upset and had hopes of being pregnant with Roethlisberger’s child.
Aug 19, '09: Roethlisberger lawyers release statement demanding McNulty drop her lawsuit and apologize
Sept 10, '09: McNulty offers to settle suit under what Roethlisberger’s attorney calls “bizarre” guidelines. McNulty said she would settle if Roethlisberger admits to the allegations, apologizes and donates $100,000 to Committee to Aid Abuse Women.
Sept. 30, '09: Judge denies Roethlisberger’s motion to dismiss
